Buying a property is one of the biggest investments we make in life. But recently, finance influencer Neha Nagar shared an important update that every property buyer and owner in India should know. According to a major Supreme Court judgment, simply registering a property in your name doesn't mean you legally own it.

Registration Doesn't Mean Legal Ownership

The Court has clarified the fact that registration of property is merely an administrative process. If the seller did not possess a clear title (legal right to sell), then registration in itself will not be enough to prove ownership. This implies that disagreements still may occur, even if your name appears on the paper.

Key Documents for Legal Property Ownership

1) A registered Will or a No Objection Certificate (NOC) from relatives or heirs.

2) A properly registered Sale Deed. An Agreement to Sell or a General Power of Attorney (GPA) isn't enough.

3) Encumbrance Certificate, Mother Deed, and all past sale deeds showing clear history.

4) Proof of payment, like bank statements showing full payment to the seller.

5) Mutation certificate and latest property tax receipts in your name.

6) Possession letter and physical possession of the house or land.

7) NOCs from the society, builder, utility providers, and any banks involved.

8) Valid ID of seller, approved building plans, and occupancy/completion certificates.

Sub-Registrar Doesn't Verify Ownership

It also made it clear that sub-registrars only verify if documents are complete—they don't confirm if the seller had the legal right to sell. That's your responsibility as a buyer.

In short, owning a property is not just about paperwork. It's about ensuring everything is legally sound and physically yours. Always perform a proper background check and seek professional legal assistance when purchasing or inheriting property.
