Recent clarifications, including an Allahabad High Court ruling, reveal that the tax treatment depends entirely on the nature of the payment.
Monthly Maintenance: Taxable Income
If alimony is paid as monthly or periodic maintenance, it is treated as income under the head “Income from Other Sources” in the Income Tax Act. This means the recipient must include it in their taxable income and pay tax according to their slab. However, any amount earmarked for child support remains exempt, even if paid regularly. This distinction is crucial for women budgeting post-divorce.
One-Time Settlement: Tax-Free
On the other hand, a lump-sum settlement is considered a capital receipt, not a revenue receipt. Courts, including the Bombay High Court in Princess Maheshwari Devi of Pratapgarh v. CIT, have consistently held that such payments are compensation for relinquishing future maintenance rights. Therefore, they are not taxable in the hands of the recipient.
For instance, in the high-profile case of Yuzvendra Chahal and Dhanashree Verma, reports suggest a one-time payment of ₹4.75 crore. Since this was a lump-sum settlement, Dhanashree owes zero tax on the amount.
Asset Transfers and Child Support
If alimony involves asset transfers, tax implications vary. Transfers before divorce are treated as gifts from a relative and are exempt. Post-divorce transfers may attract tax if their value exceeds ₹50,000, unless covered by a court decree. Child support, whether lump sum or periodic, remains tax-free, reinforcing its purpose as welfare for the child.
